Terms of use
Last updated 19 October 2026
The short version. Envoi helps a group plan trips away together. It keeps track of money but never holds or moves it. You're responsible for what you post and who you add. It's free to use while it's in the studio. Nothing here takes away rights the law says you always have.
1. Who we are, and agreeing to these terms
Envoi is made by SPENCER AI (ABN 31 978 335 623), Victoria, Australia ("we", "us"). These terms are an agreement between you and us about the Envoi app for iPhone and this website (together, "Envoi"). By downloading or using Envoi you agree to them. If you don't agree, please don't use it.
2. What Envoi is
Envoi is a planning tool for trips away: a page for each trip, a chat, tasks, ideas, plans, dates and a kitty. Its dates, totals, balances and "who owes whom" are worked out by software from what's entered, and can be wrong if what's entered is wrong. Check before you book or pay.
3. Money
- Envoi tracks money. It doesn't hold, move, collect or transfer it, and it isn't a payment service or a bank.
- Payments happen between you and your crew, outside Envoi, however you choose. We aren't a party to them and can't refund or chase them.
- Marking someone as paid in Envoi is a record, not proof of payment.
4. Price
Envoi is free while it's in the studio. If we add paid features later, they'll be sold through the App Store, and we'll update these terms and tell you in the app before anything costs money.
5. What you post, and who you add
What you write and the photos you add are yours. You're responsible for them. Please don't post anything unlawful, hateful, threatening or that you don't have the right to share, and don't add people to a trip who wouldn't want to be on it. Surprise mode helps keep a plan from the guest of honour, but it can't stop someone telling them.
6. Using Envoi properly
We give you a personal, non-transferable licence to use Envoi on Apple devices you own or control. Please don't copy, sell, rebrand or redistribute the app, reverse-engineer or tamper with it (except where the law allows), or use it in a way that breaks the law or harms anyone. The app, its design, artwork and text belong to us or are used with permission.
Fonts. Envoi and this website use Bagel Fat One, Bricolage Grotesque and Inter under the SIL Open Font License 1.1.
7. Your data
Today Envoi keeps what you enter on your phone only. We don't receive it, so we can't back it up or get it back for you. Our privacy policy explains this in full, and what will change when Envoi gets its server.
8. Changes and availability
As far as the law allows, we provide Envoi "as is" and "as available", without any promise that it will be accurate, complete, uninterrupted or error-free. Envoi is still being built, and we may update, change or stop it or any part of it.
9. Your rights under consumer law
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded, restricted or changed by agreement, including consumer guarantees. If you live outside Australia, you may also have rights under your local law that these terms can't take away. Every part of these terms applies only as far as the law allows.
10. Limits on our responsibility
As far as the law allows:
- we give no promises about Envoi other than those in these terms or that the law says must apply;
- we aren't responsible for bookings, payments or arrangements you make with other people, or for what other people post;
- we aren't responsible for any indirect or consequential loss, or any loss of data, opportunity or enjoyment;
- where the law lets us limit our responsibility for a failure to meet a consumer guarantee, our responsibility is limited to supplying the service again or paying the cost of having it supplied again;
- otherwise, our total responsibility to you for everything to do with Envoi is limited to the greater of the amount you paid us for Envoi in the 12 months before the claim, or AUD $50.
None of this limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
11. If something goes wrong
Email welcome@myspencer.ai with what happened and what you'd like us to do, and we'll try to sort it out quickly and fairly. You can also contact a consumer protection agency (in Victoria, Consumer Affairs Victoria), a regulator, or a court or tribunal at any time.
12. Apple and the App Store
If you got Envoi from Apple's App Store:
- these terms are between you and us, not Apple. We, not Apple, are responsible for Envoi and its content;
- you may use Envoi on Apple devices you own or control, as allowed by the App Store's Usage Rules;
- Apple has no duty to provide maintenance or support for Envoi;
- if Envoi fails to meet any warranty that applies, you can tell Apple, and Apple may refund the purchase price (if any). As far as the law allows, Apple has no other warranty obligation for Envoi;
- Apple isn't responsible for any claims about Envoi, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims. We are responsible for dealing with those;
- if anyone claims that Envoi, or your having or using it, infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim;
- you must follow any third-party terms that apply when you use Envoi, such as your mobile or internet provider's terms;
- you confirm that you are not in a country subject to a U.S. Government embargo or listed as a terrorist-supporting country, and you're not on any U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
13. General
Law. These terms are governed by the law of Victoria, Australia. Courts in Victoria can hear disputes about them, but you can also use the courts where you live if your local law gives you that right.
Changes to these terms. We may update these terms, for example when Envoi gets its server or the law changes. We'll update the date at the top and, for a significant change, tell you in the app before it takes effect. A change won't apply to anything that happened before it. If you don't agree with a change, you can stop using Envoi and delete it.
If part doesn't work. If any part of these terms can't be enforced, it's cut back only as much as needed, and the rest still applies.
No waiver. If we don't enforce something straight away, we can still enforce it later.
The whole agreement. These terms and our privacy policy are the whole agreement between you and us about Envoi.
Moving the agreement. We may transfer these terms to another business that takes over Envoi, as long as your rights under them stay the same.
